These Terms of Service ("Terms") govern your use of the Only Once website and your purchase of products from Only Once.

By accessing our website, placing an order or purchasing a product from us, you agree to these Terms.

Please read them carefully before making a purchase.

1. ABOUT ONLY ONCE

Only Once operates this online store from Singapore.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.

References in these Terms to "Only Once", "we", "us" or "our" refer to Only Once.

2. ELIGIBILITY

By placing an order, you confirm that you are legally capable of entering into a binding agreement or have the permission of a parent or legal guardian where required.

You must provide accurate, current and complete information when making a purchase.

3. PRODUCTS

We make reasonable efforts to describe and display our products accurately.

However, colours and appearance may vary depending on lighting, photography, display settings and individual products.

Camera Object 01 uses a transparent housing. Minor cosmetic variations, marks or characteristics that do not affect normal operation may occur and do not necessarily constitute a defect.

Nothing in this section excludes any rights you may have in relation to goods that are defective, materially different from their description or otherwise protected under applicable consumer law.

4. PRODUCT IMAGES

Product photographs, videos and other visual materials are provided for illustration and reference.

While we aim to represent our products accurately, the appearance of the physical product may vary slightly from images displayed on our website.

5. PRICING

Prices are displayed in the currency indicated on our website.

We reserve the right to change product prices at any time. Any price change will not affect an order that we have already accepted, except where permitted by applicable law.

Shipping charges, taxes, duties and other applicable charges may be calculated separately.

6. PRICING AND WEBSITE ERRORS

We make reasonable efforts to ensure that product information, availability and pricing are accurate.

However, errors may occasionally occur.

If a product is listed at an incorrect price or contains a material error due to a technical, administrative or other genuine mistake, we may contact you before accepting or fulfilling the order.

Where permitted by applicable law, we may cancel an affected order and provide a full refund of amounts paid to us.

We will not intentionally use this provision to avoid fulfilling an order merely because a product subsequently becomes more valuable or desirable.

7. ORDERS

Submitting an order does not necessarily mean that we have accepted it.

We reserve the right, where reasonably necessary and permitted by applicable law, to refuse or cancel an order before fulfilment.

Reasons may include:

• insufficient inventory;

• incorrect pricing or product information;

• suspected fraud or unauthorised payment activity;

• payment failure;

• shipping restrictions;

• inability to deliver to the supplied address;

• legal or regulatory restrictions; or

• an obvious technical or administrative error.

If we cancel an order after payment has been successfully collected, we will refund the amount paid to us for the cancelled order.

8. PRODUCT AVAILABILITY

Products may be produced or released in limited quantities.

Adding an item to your cart does not reserve inventory.

A product may become unavailable before checkout is completed.

We do not guarantee that a particular product, edition or quantity will be restocked once sold out.

9. ORDER LIMITS

We may impose reasonable limits on the quantity of products purchased by a single person, household, account, payment method or address.

Where we reasonably believe that an order has been placed for unauthorised resale, fraud, circumvention of purchase limits or other abusive purposes, we may refuse or cancel the order where permitted by applicable law.

10. PAYMENT

You agree to provide accurate and authorised payment information.

Payments are processed through Shopify and/or third-party payment providers.

Your payment may be subject to additional verification or security checks performed by us or our payment providers.

We are not responsible for delays caused solely by your bank, card issuer or payment provider.

11. SHIPPING

Orders are shipped from Singapore.

Shipping destinations, methods, rates and estimated delivery times are described on our Shipping page or displayed during checkout.

Delivery dates and times are estimates unless expressly stated otherwise.

We are not responsible for delays caused by customs processing, postal or courier disruptions, severe weather, transportation interruptions, regulatory action or other circumstances outside our reasonable control, except to the extent responsibility cannot legally be excluded.

12. SHIPPING INFORMATION

You are responsible for providing a complete and accurate shipping address and contact information.

If you discover an error after placing your order, please contact us as soon as possible.

We cannot guarantee that shipping information can be changed after an order has entered processing or been dispatched.

Where a parcel is returned, delayed or requires additional shipping because of incorrect or incomplete information supplied by the customer, reasonable additional costs may be charged to the customer where permitted by applicable law.

13. INTERNATIONAL ORDERS

International orders may be subject to VAT, import duties, tariffs, taxes, customs charges, brokerage fees or other charges imposed by the destination country or relevant authorities.

Unless otherwise expressly stated at checkout or required by applicable law, these charges are not included in the product or shipping price and are the responsibility of the buyer or recipient.

You are responsible for complying with applicable import requirements in your destination country.

Customs authorities may delay, inspect or otherwise process international shipments independently of Only Once.

14. REFUSED OR UNCLAIMED INTERNATIONAL ORDERS

If you refuse a shipment, fail to collect it, fail to pay applicable destination-country charges, or otherwise fail to complete required customs or delivery procedures, the parcel may be returned to us.

Where this occurs for reasons attributable to the customer, any refund will generally be considered only after the product has been returned to and received by Only Once.

Where permitted by applicable law, reasonable outbound shipping, return shipping, duties, customs, storage, handling or other costs incurred as a result may be deducted from any refund.

15. RETURNS AND REFUNDS

Returns, refunds and cancellations are governed by our Returns & Refunds Policy.

Unless otherwise required by applicable law, we do not provide returns or refunds solely for change of mind, personal preference, accidental purchases or because a product is no longer wanted.

Nothing in these Terms limits rights or remedies that cannot legally be excluded.

16. WARRANTY

Certain Only Once products may include a limited warranty.

Our voluntary warranty is provided in addition to, and does not replace or limit, statutory consumer rights that cannot legally be excluded.

17. PRODUCT USE

You are responsible for using, charging, storing and caring for products in accordance with the instructions supplied with the product.

You should not disassemble, modify or attempt unauthorised repairs to electronic products.

Damage caused by misuse, accidents, improper storage, unauthorised modification or failure to follow reasonable product instructions may not be covered by our voluntary warranty, subject to applicable law.

18. WEBSITE USE

You may use our website only for lawful purposes.

You must not knowingly:

• interfere with the operation or security of the website;

• attempt to gain unauthorised access to our systems;

• introduce malicious code;

• use automated systems to abuse our checkout or purchasing processes;

• impersonate another person;

• submit fraudulent information;

• infringe our intellectual property rights; or

• use the website in violation of applicable law.

We may restrict access to our website where reasonably necessary to protect Only Once, our customers or our systems.

19. INTELLECTUAL PROPERTY

Unless otherwise stated, the Only Once name, branding, product designs, photographs, films, graphics, written material, website design and other original content displayed on this website are owned by or licensed to Only Once.

You may view and use the website for personal, non-commercial purposes.

You may not reproduce, distribute, commercially exploit, modify or use our intellectual property without permission, except where permitted by applicable law.

Purchase of a product does not transfer ownership of any Only Once intellectual property associated with that product.

20. THIRD-PARTY SERVICES

Our website may use or link to services operated by third parties, including Shopify, payment providers, shipping providers and other service providers.

We are not responsible for third-party services that are outside our reasonable control.

Your use of third-party services may also be subject to their own terms and privacy policies.

21. WEBSITE AVAILABILITY

We do not guarantee that the website will always be uninterrupted, error-free or available.

We may temporarily suspend, modify or discontinue parts of the website for maintenance, security, technical or operational reasons.

22. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Only Once will not be liable for indirect, incidental, special or consequential losses arising solely from your use of the website or products where such liability may lawfully be excluded.

To the maximum extent permitted by applicable law, our aggregate liability arising from a particular purchase will not exceed the amount paid to Only Once for the product giving rise to the claim.

These limitations do not apply where liability cannot lawfully be excluded or limited, including any mandatory rights or remedies available under applicable consumer protection law.

Nothing in these Terms excludes liability for fraud or any other liability that cannot legally be excluded.

23. INDEMNITY

To the extent permitted by applicable law, you agree to be responsible for losses reasonably incurred by Only Once as a direct result of your unlawful use of our website, your infringement of our intellectual property rights, or your fraudulent conduct.

Nothing in this section requires a consumer to indemnify Only Once for losses caused by Only Once's own breach, negligence or conduct where such liability cannot lawfully be transferred.

24. PERSONAL INFORMATION

Our collection and use of personal information is governed by our Privacy Policy.

By using our website, you acknowledge that certain information may be processed by Shopify and other service providers necessary to operate our store, process payments and fulfil orders.

25. ELECTRONIC COMMUNICATIONS

When you place an order, you agree to receive transactional communications necessary to process and fulfil that order, including order confirmations, payment information, shipping notifications and customer-service communications.

Marketing communications will be handled separately in accordance with applicable law and your communication preferences.

To the extent permitted by applicable law, we are not responsible for delay or failure to perform an obligation caused by circumstances outside our reasonable control.

The version applicable to your purchase will generally be the version in effect when your order was placed, except where changes are required by law.

28. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

29. NO WAIVER

If we do not immediately enforce a provision of these Terms, this does not necessarily mean that we have waived our right to enforce it later.

30. ENTIRE AGREEMENT

These Terms, together with our applicable Privacy Policy, Shipping Policy, Returns & Refunds Policy, Warranty terms and other policies expressly incorporated into them, form the agreement governing your purchase and use of our services, subject to any rights that cannot legally be excluded.

31. GOVERNING LAW

These Terms are governed by the laws of Singapore.

Any dispute arising from these Terms will be subject to the jurisdiction of the courts of Singapore, except where applicable consumer law gives you mandatory rights to bring a claim in another jurisdiction.
